Specific products may have additional terms, which will be presented where applicable.

Services purchased through third-party platforms, including the Apple App Store and Google Play, may also be subject to those platforms' terms.

3. Eligibility and Accounts

You must be at least 18 years old, or have the permission of a parent or legal guardian where permitted by applicable law, to make purchases.

Where an account is required, you agree to provide accurate information and maintain the confidentiality of your login credentials.

You are responsible for activity conducted through your account, except where caused by circumstances for which Media Minds is legally responsible.

Accounts are personal and may not be transferred or shared without authorisation.

4. Prices and Payments

Prices are displayed in the currency indicated at checkout.

Applicable taxes, including VAT where required, will be disclosed before payment is completed.

Payments may be processed by secure third-party providers, including Stripe, Apple and Google.

Media Minds does not ordinarily store complete payment-card details.

Purchases are confirmed once payment has been successfully authorised and the order has been accepted.

We reserve the right to change prices prospectively. Price changes will not affect completed purchases or existing subscription periods. Changes to recurring subscription prices will be communicated in advance as required by law.

5. Digital Content and Delivery

Digital products are generally delivered electronically through account access, downloads, email or application activation.

Delivery instructions will be provided following purchase.

Customers are responsible for ensuring their devices, software and internet connections meet any technical requirements disclosed before purchase.

Media Minds will take reasonable steps to maintain access to purchased content, subject to the access period and conditions specified at the time of sale.

Unless expressly advertised as permanent, purchasing digital content does not guarantee indefinite availability.

Nothing in these Terms limits statutory rights concerning the conformity, functionality, security or availability of digital content and services.

6. Right of Withdrawal and Refunds

6.1 Consumer withdrawal rights

Consumers purchasing online generally have a statutory right to withdraw from a distance contract within 14 calendar days, subject to applicable legal exceptions.

6.2 Immediate delivery of digital content

For digital content not supplied on a tangible medium, such as downloadable materials or recorded courses, the statutory withdrawal right may be lost once performance begins, provided the customer has:

Where these requirements have not been satisfied, the applicable statutory withdrawal right remains available.

6.3 Digital services and subscriptions

Digital services, including ongoing subscriptions, are subject to the withdrawal rules applicable to their particular contractual structure.

Starting a subscription or accessing a service does not automatically eliminate statutory withdrawal rights.

Any legally permitted charges for services provided during a withdrawal period will be calculated in accordance with applicable law.

6.4 Defective or non-conforming products

Customers retain all mandatory statutory remedies where digital content, software or services fail to conform to the contract.

These rights are separate from any voluntary refund policy.

6.5 Refund requests

Refund and withdrawal requests may be submitted to hello@media-minds.net.

Where applicable, refunds will be processed within the legally required period and through the original payment method unless otherwise agreed.

Purchases made through Apple or Google may need to be managed through the relevant platform, without prejudice to applicable consumer rights.

7. Subscriptions and Automatic Renewal

Some Media Minds products are offered through recurring subscriptions.

Before subscribing, customers will be informed of the applicable price, billing frequency, renewal conditions, minimum commitment (if any) and cancellation procedure.

Unless otherwise stated, subscriptions renew automatically until cancelled.

Customers may cancel future renewals through the relevant account settings, payment platform or customer support channel.

Cancellation normally takes effect at the end of the current paid billing period, subject to mandatory legal rights and any more favourable product-specific terms.

Cancellation does not automatically entitle a customer to a refund for a billing period already commenced, except where required by law.

Media Minds will not impose undisclosed cancellation charges.

8. Software Licensing

When purchasing or accessing a Media Minds software application, you receive a limited, non-exclusive, non-transferable licence to use the software in accordance with the purchased plan and applicable law.

Unless expressly authorised, you may not:

Ownership of the software and its intellectual property remains with Media Minds or its licensors.

Licence duration and device restrictions, if any, will be specified in the relevant product description.

9. Intellectual Property

All original Media Minds content, including course materials, videos, software, frameworks, graphics, text, branding and educational resources, is protected by applicable intellectual property laws.

Purchasing a product grants permission to use it within the scope of the licence supplied. It does not transfer ownership of intellectual property.

Unless expressly authorised in writing, customers may not reproduce, publish, distribute, resell, publicly display or commercially exploit Media Minds content.

Customers may not upload substantial portions of protected Media Minds content to third-party platforms, AI training datasets or commercial content repositories without authorisation, except where permitted by applicable law.

Any permitted quotation, educational exception or other statutory limitation remains unaffected.

10. Acceptable Use

Users agree not to:

Media Minds may suspend or restrict access where reasonably necessary to address serious violations, security threats or unlawful activity.

Where appropriate, users will receive notice and an opportunity to remedy a violation.

11. Availability, Updates and Changes

We aim to provide reliable services but cannot guarantee uninterrupted availability.

Maintenance, technical failures, security incidents and circumstances beyond our reasonable control may occasionally affect access.

Software updates may introduce improvements, security fixes or functionality changes.

We will provide updates required by applicable consumer law and inform customers where legally necessary.

Changes affecting paid digital services will be made only in accordance with applicable contractual and consumer protection requirements.

12. Educational Content Disclaimer

Media Minds courses and educational materials are provided for professional development and general educational purposes.

We aim to deliver accurate, useful and high-quality content but do not guarantee particular professional, financial, academic or commercial outcomes.

Results depend on individual circumstances, effort and application.

Educational materials do not constitute personalised legal, financial or other regulated professional advice unless expressly stated.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Media Minds will not be liable for losses that are not reasonably foreseeable consequences of a breach of contract or failure to exercise reasonable care.

Media Minds does not exclude or limit liability where doing so would be unlawful, including liability arising from fraud, intentional misconduct or mandatory consumer protection obligations.

Nothing in these Terms restricts customers' statutory rights or remedies.

14. Third-Party Services

Our products may integrate with third-party providers for payments, authentication, hosting, analytics, video delivery or other functionality.

These providers may have their own terms and privacy policies.

Media Minds is not responsible for independent third-party services beyond its applicable legal or contractual obligations.

15. Privacy and Data Protection

Personal data is processed in accordance with our Privacy Policy and applicable data protection legislation, including the EU General Data Protection Regulation (GDPR).

Please consult our Privacy Policy for information about the data we collect, our legal bases for processing, retention periods, recipients and your rights.

16. Termination and Suspension

Users may stop using our services at any time.

Media Minds may suspend or terminate access where a user materially breaches these Terms, engages in unlawful activity or creates a serious security risk.

Any suspension or termination will be proportionate to the circumstances and consistent with applicable law.

Termination does not affect accrued rights, outstanding payment obligations or provisions intended to survive termination.

17. Changes to These Terms

Media Minds may update these Terms to reflect changes in law, technology, products or business operations.

The current version will be available on our website, with its effective date.

Where changes materially affect existing customers, appropriate advance notice will be provided and any legally required consent or termination rights will be respected.

Changes will not retrospectively remove rights already acquired by customers.

18. Governing Law and Disputes

These Terms are governed by Spanish law.

For consumers residing in the European Union, this choice of law does not deprive them of mandatory protections available under the laws of their country of habitual residence.

Disputes will be subject to the courts and authorities competent under applicable law.

Nothing in these Terms restricts a consumer's right to bring proceedings in a legally competent jurisdiction.

Customers are encouraged to contact Media Minds first so that concerns can be resolved amicably.
